Kenneth Broadnax, 41, of Augusta, Georgia, admitted to having 24 glassine envelopes of heroin on April 10.
His plea deal convicts him of third-degree criminal possession of a controlled substance, 2 years in jail with three years of post release supervision, suspends his driver’s license and requires him to surrender cash and cell phones he had on him when he was arrested.
In 2006, Broadnax was convicted of felony third-degree sale of a controlled substance.
“Because of that status — prior conviction — you’ll be sentenced as a second felony offender,” Judge John Rowley said.
Broadnax is being held without bail until his formal sentencing in about six weeks.
Previously reported
Broadnax was a passenger in a vehicle that was stopped for a traffic violation around 1:30 a.m. Police found heroin in the vehicle and took him into custody.
At police headquarters, Broadnax was seen “attempting to secrete suspected narcotics in his body,” according to a news release.
A judge signed an order to take Broadnax to Cayuga Medical Center to get the drugs removed. There, however, Broadnax removed the drugs and tried to swallow them.
“After a brief struggle, the items were recovered but only after some of the powder substance was dispersed in the treatment room,” a news release said.
Four officers were treated for possible exposure to heroin and then released from the hospital.
Broadnax was originally charged with third-degree criminal possession of a controlled substance, obstructing government administration and tampering with physical evidence.
