ITHACA, N.Y. — Two men who pleaded guilty to having heroin in Ithaca were sentenced Friday afternoon at the Tompkins County Courthouse.
Naquan Stevenson, of Brooklyn, pleaded guilty to felony fifth-degree criminal possession of a controlled substance in June after he was found with 20 bags of heroin in Ithaca. He was sentenced to one year of incarceration and one year of post-release supervision.
Stevenson has no other felony convictions, but Judge John Rowley said his file was telling.
Rowley pointed out that Stevenson has not worked in three years and has no physical or mental disabilities.
“I think the report says a lot by what it doesn’t say,” Rowley said. “You can keep playing this game all you want…You will be sentenced.”
Also appearing before Rowley today was Javaun Delfyette, also of Brooklyn, who pleaded guilty to felony third-degree criminal possession of a controlled substance in June.
His lawyer said Delfyette’s plea deal originally may have stated that he could be sentenced to a drug rehabilitation facility, but Rowley said the defendant’s status as a predicate felon means he’s not eligible.
Delfyette will have about a week to decide whether he wants to accept the plea terms of two years in prison and two years of post-release supervision or reject the deal based on his ineligibility for drug treatment.
Assistant District Attorney Eliza Filipowski said the defendant was found with 108 bags of heroin.
The charges stem from a Nov. 25, 2014 arrest in the town of Ithaca by local and state law enforcement. Delfyette was apprehended by police while driving on Pine Tree Road, and Stevenson was also found in the area. The apprehension revealed approximately $1500 worth of heroin and crack cocaine as well as $695 in cash.
Also sentenced in court Friday afternoon was Tyrone A. Freeman, of New York City. He was sentenced to five years of probation for fifth-degree criminal possession of a controlled substance as part of a plea deal.
Police said Freeman was found with heroin in his “crotch area” when police searched a vehicle he was driving in January with Christopher M. Merkley. Merkley was also charged with having heroin and cocaine.
