ITHACA, N.Y. — The National Labor Relations Board will resume its hearing Monday investigating Cayuga Medical Center.

The board is investigating allegations that Cayuga Medical Center fired two nurses because of their union activity. The hospital denies the charges and claims it fairly terminated the nurses after they violated blood transfusion protocol.

Last year, the hospital was found to have violated federal labor law by interfering with nurses’ unionizing efforts. The NLRB judge in the previous case also determined Cayuga Medical Center had unlawfully disciplined nurses, including Anne Marshall, one of the nurses who was fired. The hospital disagreed with the NLRB’s ruling and has filed an appeal.

Two nurses have testified so far that “common practice” of blood transfusions differs from hospital policy.

During opening statements of the hearing, Jessica Noto, field attorney for the NLRB, said Noto said the nurses who were fired acknowledge that they did not follow standard procedure when administering the blood transfusion, but said the evidence will show that they performed the transfusion “in the same manner that many of the ICU nurses performed the blood transfusions throughout the years.”

The hearing initially began Jan. 9 but was adjourned Jan. 12.

The hearing is open to the public. It was previously held at the Tompkins County Courthouse, but note that some locations are different this time.
